Everton to avoid retrospective punishment after Manchester City-Premier League update

Everton are unlikely to receive retrospective punishment after new legal developments at Manchester City, according to football finance expert Dan Plumley.

The Toffees served as witnesses in City’s legal case against the Premier League which declared rules governing commercial deals between clubs and related companies were declared unlawful [The Times, 7 October].

While Plumley expects the Premier League’s rules to be changed quickly, he doesn’t believe the Toffees or any other teams will be handed “severe consequences” after this latest ruling.

“The main thing here we’re focusing on is the shareholder loan’s position,” Plumley exclusively told Goodison News.

“Part of the verdict here was around non-interest baring shareholder loans should be viewed in the same way as associated party transactions.

“A lot of the media stuff that we’ve seen so far has been around clubs that have those interest-free loans from their owners and Moshiri and Everton would be an example of that.

“It’s unlikely that any retrospective punishment is applied there with regards to PSR, I think. What’s likely is that we’ll see a quick change in the rules and maybe some refinancing or capitalisation of clubs doing that.

“It’s fairly straightforward and common in football to convert shareholder loans into equity and we’re looking at a time here when Everton are on the brink of a new takeover.

“I think it will have some implications for the wider league of course and there will be some tweaking of the rules now with some adjustments.

“But I think in terms of severe consequences for some of these clubs, I think it’s unlikely given where the landscape is at with PSR at this minute.”

What does Manchester City’s legal development mean for Everton?

Everton have already faced more than their fair share of punishment from the Premier League over the last few years, so it is a relief to hear that they are unlikely to face consequences after this latest case.

Hopefully, with a takeover around the corner and some positivity finally ahead of the Toffees, the days of point deductions and PSR breaches may finally be finished at Goodison Park.
