Legal expert highlights key question Everton will ask in £35m Burnley appeal as timeline emerges
The Toffees have had their fair share of financial woes over the years.
Until the Friedkin Group came in, there were genuine fears that the Goodison outfit could tumble down the leagues.
That resulted in a number of financial rule breaches and points deductions on Merseyside.
Even with all that going on, the L3 outfit remained in the Premier League to maintain their record of never being relegated from the division.
The same can't be said of Burnley as they were relegated in 2022 before taking up a legal battle against Everton.
Why did Burnley start a legal battle against Everton?
Cast your mind back to the 2021-22 season as Rafael Benitez opened the campaign as Toffees boss.
Duncan Ferguson took over as interim mid-way through the campaign and helped keep his side in the division.
Everton were found to have breached the Premier League's profit and sustainability regulations across a three year period that season.
Burnley were relegated in the same campaign and have since argued that the Blues' rule-breaking impacted their chances of avoiding relegation.
The Merseysiders were ordered to pay £35m to the Clarets as a result of their case in an unprecedented action.
There was no waiting around at Hill Dickinson Stadium as an appeal was lodged that could hinge on one factor.
When could Everton learn Burnley appeal result?
The Premier League are yet to return with an answer to the Toffees' appeal.
It has been nearly two months since it was lodged, but there is currently a lack of light at the end of the tunnel.
Daniel Baker Senior Associate at Knights and believes that a result could come out quite soon.
He has represented elite-level coaches, athletes, clubs and organisations within football, including cases within the Court of Arbitration for Sport (CAS).
The Senior Associate has suggested that one question will be asked by Everton to deem whether their appeal will be successful.
Speaking exclusively to Goodison News, Baker said: "Burnley were always threatening to seek compensation for their relegation because they felt that Everton essentially, by cheating the rules, were liable for all the losses that occurred through relegation.
"Burnley said they suffered about £50m worth of loss. The Premier League commission thought that it wasn't that extensive, but were convinced that Everton were significantly responsible. It is currently being appealed by Everton through the Premier League appeal process.
"It's started already so that may land in a matter of weeks or months. They will be assessing whether or not the original decision was legally sound.
"Everton say there's a range of reasons why a team could get relegated. Is it legally sound that Everton's overspending led to another team being relegated? They will dispute that."
Burnley will now have the task of proving that the Blues were directly responsible, otherwise there could be a way that the L3 outfit win their appeal.
